General Terms and Conditions for use of the gutenberg.agency site

These general terms and conditions of use (hereinafter the “GTC”) apply to the website with the URL www.gutenberg.agency (hereinafter the “Site”), published by the company Gutenberg Networks (hereinafter “GUTENBERG”).

By using this Site, you are accepting the GTC below and GUTENBERG’s Personal Data Protection Policy, which can be accessed here and on the Site, which you should read and be sure to understand. Should you refuse to accept these GTC or GUTENBERG’s Personal Data Protection Policy, we kindly request that you refrain from use of the Site. Any visit to and/or use of this Site must be made in compliance with these GTC and laws applicable in France, in particular as relates to communications on the Internet.

Purpose of the Site

GUTENBERG created this Site for the personal information of its users.

This Site was created for all internet users wishing to find out more about GUTENBERG in France and elsewhere in the world, its activities, its products, and its services.

Intellectual Property – Personality Rights

All graphic elements, images, texts, animated sequences with or without sound, logos, brands, and product names making up and/or represented on the Site are protected by intellectual property laws or simple ownership and are, depending on the case, the property of GUTENBERG or the property of a third party, including advertisers, who have given permission to GUTENBERG to represent them on the Site.

Any person (models, actors, GUTENBERG’s employees, etc.) represented on the photos and films published on this Site have agreed to the use of their image or other attributes of their personality in campaigns produced by GUTENBERG for its customers or for GUTENBERG’s communications.

Site users shall not in any way, even partially, reproduce, represent, or use such an element, and photos and films in particular, without the prior explicit and written approval of GUTENBERG. Any person using these elements, even partially, without approval, shall be subject to legal prosecution.

This entire Site constitutes a work protected by applicable intellectual property laws. It shall not be reproduced and/or represented, partially or fully, without the prior explicit and written permission of GUTENBERG

Any download, reproduction, representation, adaptation, translation, and/or transformation, whether in full or in part, or transfer to another Site or another form of media (paper, digital media, film, etc.) is strictly prohibited without the prior explicit and written permission of GUTENBERG and may result in legal prosecution.

GUTENBERG’s responsibilities

Access, operation, and continuity of the Site

GUTENBERG cannot guarantee access to, the operation of, and the continuity of the Site without interruption or error.

GUTENBERG is not bound by an obligation of best efforts as relates to the access, operation, and continuity of the Site. The Internet and computer and telecommunications systems are subject to errors, interruptions and malfunctions may occur. GUTENBERG does not offer any guarantee related thereto and shall not be held responsible for any direct or indirect damages resulting from use of the Site, regardless of the cause; in particular, GUTENBERG shall not be responsible for any alteration or fraudulent access to data and/or accidental transmission due to a virus.

Similarly, it cannot be held liable for any events due to a case of force majeure, malfunctions, or technical problems involving the hardware, programs, and computer applications, or the Internet, that could cause the Site to be suspended or cease operating.

Moreover, GUTENBERG shall not be held liable in the case of improper use of the computer or an incident related to the use of the computer during use of the Site, and in particular, GUTENBERG, its directors, and its employees shall not be held liable for any damage of any kind suffered by any user, their computer equipment, and the data stored on said equipment, resulting from connection to the Site by the user, for which the user is solely responsible, nor for any consequences on the user’s personal, professional, or business activity.
The user agrees not to disturb other users’ usage of the Site and not to interfere with or interrupt the normal operation of the Site.

GUTENBERG shall make its best effort to ensure the accuracy and updating of information shared on the Site, the content of which it reserves the right to correct or modify at any time, without notice. The information provided on the Site is for information purposes, and GUTENBERG cannot guarantee the exactness, accuracy, and exhaustiveness of information provided on the Site.

No personal information concerning the user shall be transmitted to any third party or used for any unintended purposes. It may, however, be used for processing for anonymous statistical purposes.

Applicable law

This Site and these GTC are subject to French law.

Any interpretation, objection, or claim concerning this Site shall be under the jurisdiction of the courts of Paris.

Should one provision of these GTC be found invalid or declared to be invalid in application of a law or regulation or by the final decision of a competent court, all other provisions shall remain in effect.

Amendment of the GTC

GUTENBERG reserves the right to change, amend, supplement, or delete all or part of these GTC, at its sole discretion and at any time.
